TER FROM ITS CHIEF ENGINEER THAT THE REPAIR, RE-
PLACEMENT OR ADDITION IS OF AN EMERGENCY NATURE
AND (2) A SPECIAL RESOLUTION IN THE MINUTES OF THE
SANITARY COMMISSION NOTING THE EMERGENCY OF
THE SITUATION.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961,

CHAPTER 195
(House Bill 194)

AN ACT to repeal and re-enact, with amendments, Section 38A of
Article 78 of the Annotated Code of Maryland (1960 Supplement),
title "Public Service Commission Law", sub-title "Railroad Com-
panies", amending the laws concerning the maintenance of yard
track margins by railroad companies in order to increase the pen-
alty for a violation thereof and to provide that each day of non-
compliance with any order of the Public Service Commission shall
be regarded as a separate violation.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 38A of Article 78 of the Annotated Code of Maryland
(1960 Supplement), title "Public Service Commission Law", sub-
title "Railroad Companies", be and it is hereby repealed and re-
enacted, with amendments, to read as follows:

38A.

In order to provide employees a reasonably safe place to work, it
shall be the duty of all persons, firms or corporations engaged in the
operation of railroads in this State to keep and maintain those mar-
gins alongside their yard tracks (except designated cleanout and
repair tracks) where such railroad employees are required to walk
frequently in the course of their duties, reasonably free from debris
and vegetation which unreasonably affects the safety of such em-
ployees while working. This section shall be enforced by the Com-
mission upon complaint and after due hearing; violations to be pun-
ishable by a fine of not less than [twenty-five dollars ($25.00) nor
more than one hundred dollars ($100.00)] one hundred dollars
($100.00) nor more than five hundred dollars ($500.00). Each day
of non-compliance with any order issued by the Commission under
the provisions of this section shall be regarded as a separate violation.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.
