CHAPTER 665
(Senate Bill 560)

AN ACT to repeal and re-enact, with amendments, Section 92 of
Article 81 of the Annotated Code of Maryland (1957 Edition),
title "Revenue and Taxes", sub-title "Redemption in General",
relating generally to the amount required for certain redemption
of property sold at tax sales in Somerset County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 92 of Article 81 of the Annotated Code of Maryland
(1957 Edition), title "Revenue and Taxes", sub-title "Redemption in
General", be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:

92.

The owner or other person having an estate or interest in the
property sold by the collector may redeem the said property at any
time until the right of redemption has been finally foreclosed under
the provisions of this sub-title, by paying to the collector the amount
required for redemption as hereinafter set forth. Provided that in
Somerset County any owners or other person as aforesaid who shall
redeem within one year after the tax sale may do so by paying the
amount of the tax indebtedness for which the property was sold,
together with interest at the rate of 6% per annum, taxes due on the
property since the tax sale and those expenses incurred by the col-
lector pursuant to Section 76 of this Article, and no more.
Upon re-
ceipt of the proper amount, the collector shall notify the holder of
the certificate of sale that the property has been redeemed and that
upon surrender of the certificate of sale all redemption money re-
ceived by him will be paid to the said holder. For the purposes of this
section, the collector is authorized to conclusively presume that the
original purchaser at the tax sale is the holder of the certificate of
sale, unless and until the collector receives a written notice advising
him of any assignment thereof and giving him the name and address
of the assignee. The collector shall execute and deliver to the person
redeeming the property a certificate of redemption which may be
recorded among the land records of the county in which the land is
located, and when so recorded shall have the same effect as a release
of mortgage.

Sec. 2. And be it further enacted. That this Act shall take effect
June 1, 1961.
