C H A P.
LII.

Nuifances to
be removed,
&c.

V. And be it enacted, That the faid commiffioners, when they difcover any
nuifances in faid town, fhall direct the perfon or perfons caufing the fame to re-
move the faid nuifances, and if fuch perfon or perfons fhall not remove the fame
within five days after fuch notice, the faid commiffioners fhall caufe the fame to
be removed, and charge the money expended in the removing the fame to the
perfon or perfons caufing the fame.

VI. And be it enacted, That if any perfon fhall permit or fuffer his chimney
to catch fire, fo as to blaze out of the top, fuch perfon or perfons fhall forfeit
and pay the fum of feven fhillings and fix-pence current money for every fuch
offence.

How-fines are
to be recover-
ed, &c.

VII. And be it enacted, That all fines and forfeitures impofed by this act, and
all fums of money laid out by the commiffioners of faid town for the removing
of nuifances, fhall and may be recovered by the faid commiffioners before any
fingle magiftrate, in the fame manner as fmall debts out of court, and applied to
the ufe of faid town.

Paffed De-
cember 22.

An ACT for refurveying and laying out anew Snow-Hill-town,
in Worcefter county.

Preamble.

WHEREAS it is reprefented to this general affembly, that the plot of
faid town, made by virtue of an act of the general affembly paffed in
the year feventeen hundred and forty-two, cannot be found, and the
boundaries and limits of the ftreets, lanes and alleys, as well as many of the lots
thereof, are not known, whereby the titles of the proprietors thereof are preca-
rious and uncertain, and it is prayed that the fame may be laid out anew, which
appears to this general affembly to be reafonable and proper ;

Commiffion-
ers appointed
&c.

II. Be it enacted, by the General Affembly of Maryland, That Ifaac Houfton,
Jofiah Mitchell, James Bacon, John Gunby and John Selby Purnell, be and
they are hereby appointed commiffioners, who fhall on or before the firft day of
May next, meet at Snow-Hill-town aforefaid, and having fo met, the faid com-
miffioners, or any three of them; fhall have full and ample power and authority
to direct the furveyor of Worcefter county for the time being to furvey and make
out a new and exact plot of the town, and fhall afcertain and limit the extent
of the lots, ftreets, lanes and alleys thereof, according to the beft evidence that
can be obtained.

Who may if-
fue fummons
&c.

III. And be it enacted, That the faid commiffioners, or any two of them,
are hereby authorifed and required, having firft given ten days notice of the time
and place of their meeting, to iffue fummons for fuch perfons as may be applied
for by any of the proprietors aforefaid, who are hereby required to attend, under
the penalty of twenty fhillings current money for every neglect or refufal, and to
examine them upon oath, or affirmation, touching and concerning their know-
ledge of the bounds, limits and extent, of any of the lots, ftreets, lanes and al-
leys, of the faid town, and to eftablifh the fame accordingly.

And caufe the
plot to be re-
corded, &c.

IV. And be it enacted, That the faid commiffioners, or any two of them, fhall
caufe the faid plot, when finifhed, together With the depofitions by them taken,
to be entered on the records of Worcefter county, and the fame fhall be thereaf-
ter confidered, deemed and taken to be, the true plot of Snow-Hill-town afore-
faid, and the proprietors of lots and houfes in faid town fhall be vefted with as
good, fure, and indefeafible eftate of inheritance, in fee-fimple, of, in and to
their feveral and refpective lots and houfes, laid down in the manner herein di-
rected, as if the original plot had never been loft.

How vacan-
cies are to be
filled.

V. And be it enacted, That if any one or two of the commiffioners aforefaid
fhall die, refufe, neglect, or be rendered incapable to act a majority of the re-
maining commiffioners may appoint fome other in place of the perfon who
