THOMAS SIM LEE, Efquire, Governor.

1792.

II. Be it enacted, by the General Affembly of Maryland, That the market-
hours for faid market fhall be from half an hour before funrife to ten o'clock ;
and it fhall be the duty of the clerk of faid market, at the opening of faid market
to give notice thereof, by ringing a bell or giving fome other fignal; and if any
perfon or perfons fhall fell or purchafe any provifions before the market-hours
aforefaid, fuch perfon or perfons fhall forfeit and pay, for every fuch offence, a
fum not exceeding ten fhillings, to be recovered before a juftice of the peace as
fmall debts are recovered, to be applied by the commiffioners of the town to the
keeping faid market-houfe in repair.

XLIII.

Market-
hours, &c.

III. And be it enacted, That all provifions brought to faid market fhall be
found, and of good and fufficient weight and meafure, to be weighed and mea-
fured, if neceffary, by the clerk of faid market; and if any provifion brought to
faid market fhould not be found, or not of fufficient weight and meafure, it is
hereby declared to be the duty of faid clerk to feize the fame, and to lay fuch
provifions, with the caufe of fuch feizure, before fome juftice of the peace, who
is hereby authorifed to condemn faid provifions if unfound or deficient, if unfound
to order the fame to be deftroyed, and if deficient in weight or meafure to be
applied to the ufes of the poor of faid county.

IV. And be it enacted, That no perfon or perfons fhall engrofs or foreftal any
provifions within the market-hours aforefaid, or within one mile coming thereto;
and if any perfon fhall engrofs or foreftal any provifion, it is hereby declared to
be the duty of faid clerk, commiffioners, and all other perfons, to complain to a
juftice of the peace, who is hereby authorifed and empowered to condemn fuch
foreftalled and engroffed provifion for the ufes mentioned in this act, or, if faid
provifions cannot be had, to fine faid foreftaller or engroffer in a fum not exceed-
ing twenty millings for every fuch offence, to be recovered as fmall debts are
recovered.

C H A P. XLIV.

Duration.

An ACT to difpofe of the eftate of William Cole, deceafed.

WHEREAS it is reprefented to this general affembly, that a certain
William Cole, late of Harford county, died without heirs, and had,
at the time of his deceafe, an equitable title to four lots of ground
lying in Belle-Air, in faid county: And whereas the faid William Cole was con-
fiderably in debt at the time of his deceafe, and it is juft and reafonable that all
the property of faid William Cole fhould be applied to the payment of his
debts; therefore,

Preamble.

II. Be it enacted, by the General Affembly of Maryland, That the chancellor
is hereby directed, authorifed and empowered, to appoint a fit and proper perfon
truftee to fell all the eftate of the faid William Cole, deceafed, on fuch terms as
the faid chancellor fhall think proper, and that the money arifing from fuch fale
be applied and appropriated to the payment and difcharge of the juft debts due
from the eftate of the faid William Cole, and the furplus, if any, fhall be dif-
pofed of as the law directs; provided, that the faid truftee appointed as aforefaid,
before fuch fale, fhall enter into bond, in the penalty of one thoufand pounds
current money, with fuch fecurity as fhall be approved of by the chancellor, with
condition honeftly, faithfully and juftly, to perform and execute the truft to be
repofed in him in virtue of this act; and if the faid truftee fhall refufe to act, or
die, the chancellor fhall appoint another perfon in his room to perform the faid
truft, who fhall give bond with fecurity as aforefaid.

III. And be it enacted, That the purchafer or purchafers of all or any of the
before-mentioned lots, fhall be and they are hereby empowered to compel a con-
veyance of the fame, or any of them, in as full and ample a manner as the faid
William Cole might or could have done when living.
