XLI.

Provifo.

V. Provided always, That if any perfon or perfons againft whom any decree
fhall be made by virtue of this act, his, her or their heirs, devifees or reprefen-
tatives, or any perfon claiming under them, fhall appear in the court of chance-
ry at any time not exceeding eighteen calendar months from the time of making
fuch decree, and requeft a review of the fame, the chancellor, upon a bill filed
by fuch perfon or perfons, fhall proceed to an examination of the matters in dif-
pute, and to a final decree, according to the equity of the cafe, in the fame man-
ner as if the faid perfon or perfons, or thofe under whom they claim, had origi-
nally appeared before him.

A Supplement to the act, entitled, An act to eftablifh a market
in Frederick-town, in Frederick county, and for the regulation
of the faid market.

Preamble.

WHEREAS it is reprefented to this general affembly, by the petition of
fundry inhabitants of Frederick county, that the market law to which
this is a fupplement is defective, in as much as it does not affign at
what hour the faid market fhould begin, and there are no powers under the faid
original law inverting the clerk of faid market with authority to feize provifions
wanting fufficient weight, and to guard againft perfons foreftalling and engroffing
provifions brought or bringing to faid market during the market-hours: And
whereas the prayer of the faid petition is reafonable and juft; therefore,

II. Be it enacted, by the General Affembly of Maryland, That the market-
hours for faid market fhall be from funrife to nine o'clock in the morning; and it
fhall be the duty of the clerk of faid market, at the opening of the faid market, to
give notice thereof, by ringing a bell or giving fome other fignal; and if any per-
fon or perfons fhall fell or purchase any provifions before the market-hours afore-
faid, fuch perfon or perfons fhall forfeit and pay, for every fuch offence, a fum
not exceeding two pounds, to be recovered before a juftice of the peace, to be
applied to the purpofes of the original act.

III. And be it enacted, That all provifions brought to faid market fhall be of
good and fufficient weight and meafure, to be weighed and meafured, if neceffary,
by the clerk of faid market; and if any provifion brought to faid market fhould
not be of fufficient weight and meafure, it is hereby declared to be the duty of
faid clerk to feize the fame, and to lay fuch provifions, with the caufe of fuch
feizure, before fome juft ice of the peace, who is hereby authorifed to condemn
faid provifion to be applied to the ufes mentioned in the original act.

IV. Be it enacted, That no perfon or perfons fhall engrofs or foreftal any
provifions within the market-hours aforefaid, or within one mile coming thereto ;
and if any perfon fhall engrofs or foreftal any provifions, it is hereby declared to
be the duty of fuch clerk, and all other perfons, to complain to a juftice of the
peace, who is hereby authorifed and empowered to condemn fuch forertalled and
engroffed provifion, at his difcretion, for the ufes mentioned in the original act.
