278                               Laws of Maryland                       [Ch. 221

Article 24 of the Code of Public Local Laws of Maryland (1930
Edition), title "Worcester County", sub-title "Roads", said Section
285A having been enacted by Chapter 633 of the Acts of 1941, be
and they are hereby repealed, and that seventeen (17) new sections
are hereby enacted in lieu thereof, to be known as Sections 278 to
285, inclusive, and 285A, 285B, 285C, 285D, 285E, 285F, 285G, 285H
and 285-1 of said Article, to follow immediately after Section 277 of
said Article, and to read as follows:

278.    A County Roads Board for Worcester County is hereby
created, and the Board of County Commissioners of Worcester County
is hereby constituted said County Roads Board. Said County Roads
Board shall enter upon its duties and assume the responsibilities
and powers herein and hereinafter conferred when, but not until,
the effective date of the taking over of the roads in Worcester
County by the County Commissioners of Worcester County from
the State Roads Commission of Maryland, pursuant to the provisions
of Article 89B, Section 173 of the Code of Public General Laws of
Maryland (1956 Supplement, as amended from time to time).

279.    The County Commissioners of Worcester County shall have
control over the public roads, bridges, drains, water courses, public
landings, culverts and curbs and gutters along the same in Worcester
County, subject only to the existing rights and duties of the State
Roads Commission of Maryland, until Worcester County takes over
the construction, reconstruction and maintenance of its County roads,
pursuant to Article 89B, Section 173 of the Code of Public General
Laws of Maryland (1956 Supplement, as amended from time to
time), and thereafter the said County Roads Board for Worcester
County shall have control and shall regulate them, provided, how-
ever, that said County Roads Board shall have no authority or
control over the private toll bridge now being constructed over Sine-
puxent Bay from a point near South Point to Assateague Island by
Assateague Island Bridge Corporation.

280.    The County Commissioners of Worcester County are au-
thorized, empowered and directed at the time of making their annual
levy to levy such amount annually as in their opinion shall be neces-
sary for the building, repairing, reconstructing, maintenance and
regulation of the use of, the public roads, bridges, drains, water
courses, public landings, culverts and curbs and gutters along the
same in Worcester County, and for the purchase and maintenance of
equipment and for the purchase or rental of land or buildings to be
used for that purpose. The money so levied shall simply be designated
"For construction, reconstruction and maintenance of County roads,
bridges, drains, water courses, public landings, culverts, curbs and
gutters, and purchasing and renting of equipment, land and buildings
in connection therewith," but no part thereof shall be earmarked by
said County Commissioners for specific purposes, all such authority
to so earmark being vested in said County Roads Board. All monies
so levied and received shall be deposited by the County Treasurer
in a special fund for that purpose and paid out of that fund by the
County Treasurer on requisition of said County Roads Board. Any
unexpended surplus remaining in said account at the end of any
year may be carried over and used by said County Roads Board in
future years to carry out the purposes of this sub-title or may be
used on account of the costs of the succeeding year's roads program.
