CHAPTER 19.
|
|
|
|
AN ACT to make valid a deed from Nathan
Tyson, George Ellicott, and Edward Lee, to
Charles Timanus, and to authorise the record-
ing of the same.
|
Passed Febru-
ary 11, 1858.
|
|
|
WHEREAS, Nathan Tyson, of the city of Balti-
more, and George Ellicott and Edward Lee, of
Howard county, on the fifth day of June, in the
year eighteen hundred and fifty-five, executed
a deed to Charles Timanus, also of the said
city, conveying certain property therein named;
And whereat, the said deed has not been yet
recorded; Therefore,

Preamble.
|

|
SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That the deed of conveyance
from the said Nathan Tyson, George Ellicott, and
Edward Lee, to the said Charles Timanus, he
made as valid and effective as if the said deed had
been recorded in time, according to law, and that
the clerk of the Circuit Court for Howard county,
he, and he is hereby authorised to record the same;

Made valid.
|

|
Provided, that nothing herein contained, shall he
construed to prejudice the rights of any purchaser
for valuable consideration, without notice, or any
bona fide judgment creditor or mortgagee, without
notice, whose interests or rights may have accrued
since the execution and acknowledgment of the
said deed, And provided, that the said deed be
recorded within two months from the passage of
this act.

Proviso.

SEC. 2. And be it enacted, That this act shall
take effect from the date of its passage.
|
