LAWS OF MARYLAND.

provisions of the act of Assembly, passed at De-
cember session, eighteen hundred and twenty, chap-
ter, one hundred and: ninety-one, entitled an act to

amend and reduce into one system the laws to direct
descents, shall be ordered by the court to make sale
of the real estate in. the proceedings mentioned, and
in accordance with said order shall offer the said
real estate at public auction and the same shall be
bid off by gome purchaser or purchasers, and the
said purchaser shall afterwards refuse or neglect to
comply with the terms of sale, it shall and may be
lawful for the commissioners to resell the said real
estate upon the notice contained in the order afore-
said; and if it sell for less than at the first sale, to
compel by suit or action to be instituted in their
names as commissioners, the purchaser or purcha-
sers at the first sale, to pay over the difference or loss
that may be sustained between the first and second

sales; Provided, That a memorandum be made and

signed by the auctioneer in writing, containing the
names of the parties, the amount and terms of sale.
SEC. 3. And be it enacted, That this act shall
take effect from and after its passage.

AN ACT appropriating a sum of money to pay for
a Painting illustrating the surrender by George
Washington, of his commission as Commander in
Chief of the Army of the American Revolution,
in the Senate Chamber of Maryland, December
twenty-third, seventeen hundred and eighty-three.

Sum appro-
priated.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the sum of three thousand dol-
lars be and the same is hereby appropriated out of
any unappropriated funds in the Treasury, to pay for
a painting, for the use of the Senate Chamber, illus-
trating the surrender by George Washington; of his

commission as Commander in Chief of the American
