LAWS OF MARYLAND.

CHAP. 460.

Baltimore and Fredericktown Turnpike Road, be and
they are hereby authorised and empowered to cede
such part of their said road, including the bridges on
the same, as lie within the limits of direct taxation, to
the Mayor, Aldermen and Common Council of Fred-
erick, which have already been required and agreed
to by said Mayor, Aldermen and Common Council,
and assented to by said Turnpike Road Company, or
that may hereafter be required by said Mayor, Alder-
men and Common Council, and assented and agreed
to by said President and Managers, for the time
being, of the said Baltimore and Fredericktown Turn-
pike Road.

Cession — how
made.

SEC. 2. And be it enacted, That such cession or
cessions, as the case may be, when made, shall be
made by said Turnpike Road Company, by deed to
be executed, acknowledged and recorded according to
law, in the same way as deeds are required to be exe-
cuted, acknowledged and recorded, to pass real es-
tate.

Declared to be
a public street.

SEC. 3. And be it enacted, That whenever the said
cession or cessions are made, according to the pro-
visions of this act of Assembly, that all such part or
parts of said road, so ceded as aforesaid, shall be and
the same are hereby declared to be a public street and
high way, and subject, as such public street and high-
way, to the ordinances and regulations of the said city

of Frederick; provided however, that no ordinance or
regulation shall be passed to interrupt, or in any man-
ner affect or impede the travel on said road.

Not to remove
toll gates.

SEC. 4. And be it enacted, That the said Turnpike

Road Company shall not be compelled to remove any
of their toll gates, or to charge less toll in consequence
of any cession or cessions that has been, or that may
hereafter be made to said Mayor, Aldermen and Com-
mon Council, of said part, or any parts of said part of
aid road, anything in any other act of Assembly, to
the contrary thereof, in anywise notwithstanding.

Declared valid.

SEC. 5. And be it enacted, That the deed, and all
the agreements, covenants and stipulations therein
contained, which was made in the month of Febru-
ary, eighteen hundred and forty-nine, by the Presi-
dent and Managers of the Baltimore and Frederick-
town Turnpike Road, to the said Mayor, Aldermen
Aldermen and Common Council, and by them ac-
cepted and assented to, under their corporate seal, on
the nineteenth day of February, eighteen hundred
and forty-nine, which is recorded in Liber W B T,
number eight, folios six hundred and forty-eight, six
