CHAP. 233.

creek, and the public roads leading to said river near

survey and location of those latter roads, not to extend
more than fifty perches from said river, and the said com-
missioners are hereby authorised and required, to survey

the commissioners of Harford county, to be by them pre-
served.

Swear or affirm.

SEC. 2. And be it enacted, That each commissioner,
before be acts, shall swear or affirm that he will faithful-
ly and impartially perform the duty required of him by
this act, and each commissioner shall be allowed two
dollars per day for his services; and the said commis-
sioners may appoint a surveyor, and the surveyor so ap-
pointed shall receive for his services four dollars per day,

Proviso.

provided, that if one of the commissioners be appointed
surveyor, be shall not charge as commissioner and sur-
veyor, but as surveyor only.

Die, resign,
&c, supply va-
cancy.

SEC. 3. And be it enacted, That if any of said com-
missioners die, resign, remove, or refuse to act, the
judges of Harford county court shall appoint some dis-
creet person or persons to supply any vacancy which
may be occasioned by any of the causes aforesaid.

Summon wit-

SEC. 4. And be it enacted, That the aforesaid commis-
sioners shall have full power to summon witnesses, if
they deem it expedient, to give information in relation to
the public roads and landing.

Construct
wharves, &c.

SEC. 5 And be it enacted, That the owners of lands
located on the Tide Water Canal, in Harford county, be
and they are hereby authorised to construct wharves on
the property owned by them on said canal, and to charge
and receive wharfage for the use thereof, not exceeding
the usual rates of wharfage in the town of Havre-de-

Provisoes.

Grace or in Port Deposit; provided, that this act shall
not be so construed as to abridge or interfere in any man-
ner with the right and power now possessed by the com-
missioners of said county, to have condemned any lands
on said canal for public landings or public roads, whether
improved as wharves or not; and provided further, that
the right herein given to persons to construct wharves on
their own lands on said canal, shall not be construed to
allow any person or persons to charge and receive wharf-
age for the use of any public road or public landing on
or adjacent to said canal, nor shall the right herein given
to construct wharves, to interfere with the rights of the
Tide Water Canal Company.
