1840.

appoint an assessor, who shall, under oath, value, appraise
and assess the property in said village, in the same manner,
and with like authority as county assessors proceed to as
sess in the county; provided always, that in assessing any of
the lands within the limits of said village which may be oc-
cupied and used as farms, or may be a part or parts of
farms, that then such lands shall be valued and assessed as
Jots of ten acres of ground, with the building and improve-
ments thereon, and shall not be valued and assessed by the
number of acres in said farms, or part or parts of farms.

CHAP. 233.

SEC. 13. And be it enacted, That if any of the owners of
property assessed within said village shall conceive them-
selves aggrieved by the assessment so as aforesaid made by
said assessors, they may appeal to the said president and
commissioners, who shall have power and authority to make
such deduction for the valuation of their property as to
them shall seem reasonable and just.

SEC. 14. And be it enacted, That each and every of the
proprietors of lots binding on, and entitled to the privileges
of the water in said village, shall be, and are hereby per-
mitted to wharf out, extend and improve the whole front of
their several lots, and for such distance as from time to time
they may think fit; and that they shall be entitled solely and
exclusively to such emoluments arising from the wharfage
thereof as may be fixed upon by the said commissioners;
provided always, that the proprietors of said lots in making
out and extending the same shall be subject to the rules and
ordinances of said commissioners.

Proviso.

SEC. 15. And be it enacted, That the said commissioners
be and they are hereby empowered to pass all by-laws and
ordinances necessary to give effect and operation to all the
powers vested in this corporation; to impose lines, penalties
and forfeitures for the breach of their by-laws and ordi-
nances; provided, that no ordinance of the said commission-
ers shall impose a fine or forfeiture for any offence of more
than ten dollars.

SEC. 16. And be it enacted, That if any person or per-
sons shall refuse or of gleet to pay their taxes, fines or for-
feitures charged against them by virtue of this act, it shall
and may be lawful for the said commissioners to collect the
same in the same manner that small debts are collected out
of court.

SEC. 17. And be it enacted, That said commissioners, or
a majority of them, shall have full power and authority, an-
nually to appoint a person to be bailiff, constable and col-
