(b) The streets, alleys, highways, lanes, squares, storm
water and other drains, and water courses of the City of
Hagerstown.

And the said Board shall possess and be charged with
the exercise of any and all powers of the City of Hagers-
town incident to the full control, supervision and manage-
ment of the police of the City of Hagerstown.

83. The City of Hagerstown is hereby authorized to
own and operate its water system; the Council is author-
ized and empowered to pass all ordinances necessary to
provide for the operation, management, maintenance, en-
largement and improvement of said water system, and to
acquire property for use in said water system by purchase,
lease or condemnation; provided that condemnation pro-
ceedings shall be instituted under the general laws of the
State of Maryland.

The City is hereby authorized to furnish water to any
person, firm, corporation, or municipality anywhere in
Washington County.

84. The Council shall set all water rates, rents, and
charges, and authorization by the Council shall be neces-
sary for all enlargements and extensions of said water
system.

85. To provide the sum of money necessary to pay the
costs and expenses of conducting and operating said plant,
in the event that the revenues derived therefrom shall
not be sufficient for said purposes, the Council is hereby
authorized and empowered to levy annually a tax on the
assessable property in Hagerstown in an amount sufficient
to meet said deficiency.

86. In addition to the powers expressly conferred by
this Act, the Council of Hagerstown shall have such other
powers as are incident thereto, or a necessary conse-
quence of the powers herein conferred, which shall include
the right to pass all ordinances, not inconsistent with
the powers granted by this Act, that may be deemed
necessary for the proper preservation and protection of
said plant, its waters, streams of water and water sup-
plies, and to attach reasonable penalties for violation
thereof, to formulate, and enforce all rules and regulations
necessary for the proper conduct of the Business of said
plant, and from time to time to repeal, alter and amend
said ordinances and said rules and regulations.
