replacement only, unless and until all the following re-
quirements shall have been fully complied with: Said
Council shall first cause to be published at least once a
week for four successive weeks in each daily newspaper
published in said Hagerstown a notice in the name of the
City, that the City proposes to sell, lease, or otherwise
dispose of, as the case may be, certain property, describ-
ing it, used in the operation of or in connection with the
municipal electric light plant, said notice to be published
not more than three months before the election at which
the question of such proposed sale, lease or other disposi-
tion of said property is to be voted on as hereinafter pro-
vided for; said Council shall then have the question of
such proposed sale, lease, or other disposition of said prop-
erty* submitted to the vote, of the duly qualified voters of
said Hagerstown at the next general municipal election
thereafter; and if a majority of the duly qualified voters
voting on said question shall vote "For" the proposed sale,
lease, or disposition of said property, as the case may be,
then said Council shall have the power and authority to
make the proposed sale, lease, or other disposition of the
property described in the said published notice; but if a
majority of the duly qualified voters voting on said ques-
tion shall vote "Against" the proposed sale, lease, or dis-
position of said property, as the case may be, then it shall
be unlawful for the City, and said City shall not have any
power or authority, to make the proposed sale, lease, or
other disposition of said property.

82. There is hereby created and continued a Board of
Public Works, formerly known as the Board of Street
Commissioners, consisting of three members. The three
members of the Board of Street Commissioners in office
at the time of the adoption of this Charter shall constitute
the Board of Public Works and shall continue in office
and each shall serve out the term of his appointment. On
or before the first day of March in each and every year,
or as soon thereafter as practical, the Mayor, with the
advice and consent of the Council, shall appoint one person
as a member of such board to serve for a term of three
years or until his successor is appointed and qualified. The
Board of Public Works shall possess and be charged with
the exercise of any and all powers of the City of Hagers-
town incident to the full control, operation, management,
maintenance, repairs and improvements of the following:

(a) The Municipal Electric Light and Power Plant.
