all bonds heretofore issued to set up said electric light and
power plant, and to provide for the sum of money neces-
sary to pay the costs and expenses of maintaining and
operating said light and power plant in the event that the
revenues derived therefrom shall not be sufficient for said
purposes.
79. If the revenues derived from the payment by con-
sumers for the use of electric current shall at any time
exceed the sum of money necessary to pay the costs and
expenses of operating and maintaining said plant and
making reasonable repairs, extensions and enlargements
thereof, the sum of money remaining on the first day of
April, in each year may be appropriated by said Council
toward the payment of the interest on said bonds issued
to set up said plant, and for the redemption of said bonds
when due and payable, or to the purchase in the open
market of any of said bonds, and said bonds when so paid
or purchased, shall forthwith be cancelled.
80. In addition to the powers expressly conferred by
this Act, the Council of Hagerstown shall have such other
powers are are incident thereto, or as are a necessary con-
sequence of the powers herein conferred, which shall
include the right to pass all ordinances, not inconsistent
with the powers granted by this Act, that may be deemed
necessary for the protection and preservation of said elec-
tric light and power plant, or any portion thereof, and to
attach reasonable penalties thereto for violation thereof,
to formulate and enforce all rules and regulations neces-
sary for the proper conduct of the business of said electric
light plant, and from time to time to repeal, alter and
amend said ordinances and such rules and regulations.
81. The City of Hagerstown is authorized and empow-
ered to sell and convey, lease, or otherwise lawfully dis-
pose of the whole or any part of any real estate and per-
sonal property within and/or without the corporate limits
of said Hagerstown and owned by said Hagerstown that
in the opinion of the Council is not needed for municipal
purposes; provided, however, that it shall be unlawful
for said City of Hagerstown to sell, lease, or otherwise
dispose of the whole or any part of the real estate and
personal property owned by said Hagerstown within
and/or without the corporate limits of said Hagerstown
that is now, or that shall hereafter be, used in the opera-
tion of or in connection with the municipal electric light
and power plant, except to sell or otherwise dispose of any
machinery and equipment for the purpose of immediate
