as if he had resisted a constable; and any policeman so
appointed, who shall be guilty of official misconduct, shall
be proceeded against by presentment and indictment in
the Circuit Court for Washington County, and if found
guilty, shall be fined or imprisoned, or both, in the discre-
tion of the Court.

VIII
LIGHT AND POWER PLANT

75. The City of Hagerstown is hereby authorized to
own, operate, enlarge and maintain an Electric Light and
Power Plant, and there shall be no lighting at municipal
expense of the streets, alleys, squares, lanes, highways or
other public places in said City, except by electrical or
other appliances owned, operated and maintained by said
City. Electricity produced or distributed by said plant
shall not be delivered or sold by the City of Hagerstown to
any consumer, other than one of its own departments or
agencies, outside of the taxable or corporate limits of the
City of Hagerstown. The head of the department of the
City government charged with the operation and mainte-
nance of said plant shall be a permanent officer chosen
under the established merit system.

76. The City of Hagerstown is hereby authorized and
empowered to acquire land, either improved or unim-
proved, within the limits of Washington County, Maryland,
by purchase, lease or condemnation, and if by condemna-
tion, then such proceedings shall be instituted under the
general laws of the State of Maryland, and to erect new
buildings, or change or alter such buildings thereon as may
be necessary or advisable, and to purchase and contract for
all other things necessary for the operation, management,
maintenance, enlargement, and improvement of the mu-
nicipal light and power plant.

77. All sums of money collected from consumers of
electricity produced by the light and power plant of the
City of Hagerstown shall be entered to the credit of a
separate account to be known as the light and power fund,
and the sum of money so received shall constitute part of
a separate fund to be known as the light and power fund.

78. The Council of the City of Hagerstown is hereby
authorized to levy annually on all property liable to taxa-
tion in said City an amount sufficient to pay the interest
and Ten Thousand Dollars ($10, 000) of the principal on
