63. The City of Hagerstown shall have the power to
regulate all sub-divisions of land within the corporate lim-
its of the City of Hagerstown, and also within one mile
outside thereof, and for the purpose of carrying into
effect this sub-section no plat or plan of any such sub-
division upon which any street, alley, lane, avenue,
thoroughfare, or public highway shall have been laid out,
shall be received by the Clerk of the Circuit Court for
Washington County for recording among the Land Rec-
ords of Washington County until the said plat or plan has
been approved in writing by the Council of Hagerstown
and said approval stamped thereon. The Council of Hag-
erstown shall have power to prescribe rules and regula-
tions governing the filing of plats or plans for such sub-
division and requiring all properties so sub-divided to have
permanent markers or boundary stones placed at all street
intersections, and to regulate and establish the width,
grades and building lines for all streets, alleys, lanes,
avenues, thoroughfares, public highways or sidewalks so
laid out in any sub-division.

64. The Council of Hagerstown shall have and is vested
with full power and authority to provide by ordinance for
the grading, shelling, gravelling, paving, curbing, or for
the regrading, regravelling, repaving or recurbing of any
street, lane or alley in Hagerstown, or part thereof, now
condemned, ceded, opened, widened, straightened or al-
tered according to the laws and ordinances regulating the
same; and also for assessing the costs of any such work,
in whole or in part, pro rata upon the property binding on
such street, lane or alley, or part thereof, and for collect-
ing such assessments as other City taxes are collected.

65. A tenant for ninety-nine years, or for ninety-nine
years renewable forever, or the executor or administrator
of such tenant, or guardian of an infant owner, or a mort-
gagee in possession, shall be deemed and taken as an
abutting owner of land bounded by any public thorough-
fare of Hagerstown, for the purposes of any application to
the City of Hagerstown authorized by this or any future
Act, and the application of any such person shall bind the
property so represented for any assessment or tax made
under an ordinance passed in pursuance of the provisions
of this or any future act.

66. Whenever the Council shall direct any street, high-
way, lane, alley, square, sewer, sanitary sewer, drain or
water course within the limits of the City, to be laid,
opened, extended, widened, straightened or closed up, in
