the entire cost thereof shall be paid by the abutting prop-
erty owner; provided, however, that once the abutting
property owner has paid the cost of said pavement, curb,
or gutter, and changes made in the grade or location of
said pavement, curb, or gutter for any purpose, other than
to keep said pavement, curb or gutter in a reasonable state
of repair, shall be at the expense of the City and not at
the expense of the abutting property owner.

60. The City of Hagerstown may provide by general
ordinance for the cleaning and removal of snow and ice
from the sidewalks within its corporate limits by its own
servants, agents, or contractors, and also for the cutting
and removal of weeds within the area extending between
the curb-line of any street or other highway within said
corporate limits and a line two feet back of the inside
walk line of any such sidewalk, by its own servants, agents,
or contractors, the actual or established minimum cost of
cleaning and removing snow and ice, as aforesaid, and
cutting and removing weeds, as aforesaid, to be collected
as are municipal taxes, and said charges shall be and they
are hereby declared to be liens upon the abutting property
after the same have been approved by an order of the
Council and a statement thereof placed in the hands of the
City Tax Collector and Treasurer, provided that said
property has not previously been conveyed to an innocent
party for value without knowledge of such charges; and
the Council is authorized and empowered to establish by
general ordinance aforesaid a minimum cost of cleaning
and removing snow and ice, as aforesaid, and cutting and
removing weeds, as aforesaid, of not more than five cents
for each lineal foot of sidewalk from which snow and ice
may be so cut and removed.

61. The City of Hagerstown shall have the right to
condemn the parts of all public highways, lying within
the limits of the City, for public use, and to open, widen,
straighten or close up the same, in whole or in part; pro-
vided, free access is allowed to all public roads running
to the limits of said City through the highways of the City.

62. The Council shall have and is hereby vested with
power to direct the laying out, opening, extending, widen-
ing, straightening or closing up, in whole or in part, of
any street, highway, square, lane, alley, sewer, sanitary
sewer, drain or water course within the bounds of the
City, which, in their opinion, public convenience may
require.
