offices on the second Wednesday in May immediately following
their election and the failure of the persons so nominated to
appear and qualify within the time prescribed shall be deemed
a refusal of the person failing to qualify to accept the office,
whereupon the office shall be filled by the election by the
Council of a duly qualified voter of Capitol Heights to serve as
Mayor or Councilmen, as the case may be.
153. (Mayor and Common Council—Qualifications. ) The
Government of said town shall be vested in the Mayor and
Common Council, each of whom shall have attained the age of
twenty-one years on the day of nomination, and shall have
resided within the corporate limits of Capitol Heights for not
less than two (2) years prior to the date of the nomination,
and each of whom shall be assessed individually or jointly on
the assessment books of Prince George's County, at the time of
nomination, for not less than five hundred ($500. 00) dollars
worth of property within the corporate limits of said town of
Capitol Heights, which qualifications shall exist at the time
of nomination.
154. (Mayor and Common Council—Mayor; Power and
Duties. ) The Mayor of the Town of Capitol Heights shall be
the executive officer thereof, clothed with all of the power
necessary to secure the enforcement of all ordinances passed
by the Councilmen of said town under this charter. He may
convene the Council in special session when he is of the opinion
that the public good may require.
155. (Mayor and Common Council—Mayor's Salary. ) The
Mayor shall receive for his services and expenses, the sum of
Four hundred eighty ($480. 00) dollars per year, payable in
monthly, installments of Forty ($40. 00) dollars each.
156. (Mayor and Common Council—Council, Number, Term
and Vacancies. ) Excepting, as otherwise provided in this
Charter all powers of the town shall be vested in a council of
six (6) members nominated and elected in the manner herein
provided from the town at large. The term of each Council-
man shall be for two (2) years and until his successor shall
have qualified, and shall begin on the second Wednesday of
May, immediately following the regular town election. In case
of the death, resignation, inability, or refusal to serve or re-
moval from the town of any of the members of the Council, the
Common Council shall elect some competent citizen of the town
to serve for the unexpired term.
157. (Mayor and Common Council—Council Meetings,
Quorum, Vote, Special Meetings. ) The Common Council shall
