sub-title "Cottage City", sub-heading; "Street Improve-
ments", said new section to be known as Section 361A and
to follow immediately after Section 361 of said Code and
Article, authorizing the Cottage City Commission, under
certain conditions to assess and collect from a property
owner the cost of removing weeds, rubbish, and other objec-
tionable materials from his property.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to the Prince
George's County Code (1943 Edition, being Article 17 of the
Code of Public Local Laws of Maryland), title "Prince George's
County", sub-title "Cottage City", sub-heading "Street Improve-
ments", said new section to be known as Section 361A and to
follow immediately after Section 361 of said Code and Article
and to read as follows:

361A. The Cottage City Commission shall have power to
assess against the property and collect from the owner thereof,
the cost of the removal of weeds, grass or thickets, or of refuse
and rubbish, from any land or property within the limits of
Cottage City. No such assessment shall be levied unless the
accumulation of such matter upon the lot or property shall
be such as to constitute a menace to the health and sanitary
conditions of the town, or to endanger the safety of persons
passing near such property; nor unless the owner thereof
after due notice of such conditions shall have failed for at
least fourteen days to remedy the conditions complained of.
Any such assessment when levied shall constitute a tax or
lien upon such property and may be enforced and collected
by the Cottage City Commission in the same manner as town
taxes are collected. Any person aggrieved by any action of said
Commission under the provisions, of this section shall have
the right to appeal to the Circuit Court for Prince George's
County, provided such appeal is taken within ten days next
succeeding the day on which notice of any such assessment is
given.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1945.
