448. The County Commissioners of Anne Arundel County
shall not take title to, take over, improve, or maintain any
road unless and until ,
(a) The road has been constructed, including establish-
ment of grades, grading, draining and surfacing in accord-
ance with plans prepared by the County Road Engineer or
the State Roads Commission and approved by the County
Commissioners; or
(b) [The road taxes collected for the three (3) previous
fiscal years on properties abutting on the road amount in the
aggregate to fifty percent (50%) of the cost of establishing
grades, grading, draining and surfacing the road.] The
assessed values of properties to be served by any road or
street proposed for addition to the County Road System must
equal not less than fifteen (15) times the estimated cost to
construct and improve the road to conform to standard re-
quirements of establishing grades, grading, draining and sur-
facing as may be adopted by the County Commissioners of
Anne Arundel County; and, provided that such proposed road
or street will serve not less than five dwellings or commercial
buildings per mile, or at the rate of five such buildings per
mile, of proposed road or street, and will be a road or street
of public rather than prwate convenience.
"Road" includes any road, highway, street or alley, not a
part of the County road system.

SEC. 2. And be it further enacted, THAT A NEW
SECTION BE AND IT IS HEREBY ADDED TO THE
ANNE ARUNDEL COUNTY CODE (1947 EDITION), BE-
ING ARTICLE 2 OF THE CODE OF PUBLIC LOCAL
LAWS OF MARYLAND, TITLE "ANNE ARUNDEL
COUNTY", SUB-TITLE "ROADS", SAID NEW SECTION
TO BE KNOWN AS SECTION 448A, TO FOLLOW IM-
MEDIATELY AFTER SECTION 448 OF SAID ARTICLE,
AND TO READ AS FOLLOWS:
448A. (1) NOTWITHSTANDING ANY PROVISION IN
THIS SUB-TITLE TO THE CONTRARY, THE COUNTY
COMMISSIONERS OF ANNE ARUNDEL COUNTY ARE
HEREBY EMPOWERED TO TAKE OVER AND MAIN-
TAIN AS PUBLIC ROADS ALL THE ROADS AND
STREETS LOCATED WITHIN THE BOUNDARIES OF
THE AREA WHICH PRIOR TO 1949 WAS CHARTERED
AS A TOWN AND KNOWN AS "ARUNDEL-ON-THE-
BAY". PROVIDED, HOWEVER, THAT THE SAID COM-
MISSIONERS IN THEIR DISCRETION, MAY DEED
