and Health Officer. The offices and places so classified by
the Commission shall constitute the Classified City Service
of Cumberland, and no appointment to any of such offices
or places shall be made except under and according to the
rules herein mentioned after the promulgation thereof.

33D. The Classified City Service shall include all the
positions in the said service for which it is practicable,
in the judgment of the Commission, to determine the fit-
ness of applicants by competitive examinations, and shall
include all positions and employments now existing or here-
after created of whatever functions, designations or com-
pensation, in each and every branch of the Classified City
Service except the Labor Class.

33E. The Labor Class shall include unskilled laborers
and such skilled laborers as may be so classified by the
rules and regulations of the Commission. No person shall
be included in the Labor Class whose service shall consist
of clerical work, office work, or inspection of other work
or service.

33F. The Commission shall in its rules provide among
other things:

(a) For examinations and such other tests as may in
its judgment be necessary to determine the fitness of appli-
cants for positions in the Classified City Service.

(b) For the employment of those in the Labor Class
by such method as the Board may find will produce the
best results.

(e) For the rejection of candidates who fail to comply
with reasonable requirements as to age, sex, physical con-
dition and moral character.

(d) For the preparation of lists of candidates eligible
for employment, which lists shall be arranged in the order
of the relative standing of applicants as determined by
the Commission. ;

(e) For the certification, as occasion may require, to
the appointing officer of the persons eligible to employ-
ment under the rules of the Commission, provided that in
the case of the Classified City Service such certification
shall include only the five persons standing highest on the
appropriate eligible list, or the person or persons on such
list when it contains five names or less.

33G. When a vacancy occurs or a new position is cre-
ated in the Classified Service, the appointing officer shall
