of June in the years 1940, 1944 and 1948, shall be appointed by
the Mayor with the consent of the City Council for a term of
four years, and thereafter at the expiration of the term of
any Commissioner, his successor shall be appointed for four
more years.

SEC. 102. The Municipal Utilities Commission shall annual-
ly organize by electing a Chairman, Secretary and Treasurer
no two officers of which may be filled by any one Commis-
sioner. The three Commissioners shall individually and col-
lectively give bond in the sum of Five Thousand ($5, 000. 00)
Dollars to the Mayor and City Council of Havre de Grace for
the faithful performance of his and their duties, which bond
shall be approved as to surety by the Mayor, the premium of
which shall be paid out of the Treasury of the Municipal Utili-
ties Commission. The said Commission shall keep books show-
ing accurately the receipts and expenditures of the Commis-
sion as well as Minutes of its proceedings; and said Commis-
sion shall annually on the first day of February, or as soon
as possible thereafter, in each year render to the Mayor and
City Council a statement of the receipts and expenditures of
said Commission together with a report of its activities for
the year as well as any recommendations for the improvement
of the Utilities which it operates.

SEC. 103. The said Commission is hereby vested with all
the rights and powers necessary to operate efficiently any
utility acquired or owned by the City of Havre de Grace; to
fix rates for those using products of said Utilities; to employ
such person or persons as it may deem wise and necessary to
properly operate said Utilities; make repairs, extensions, im-
provements and betterments; buy materials and supplies; and,
in general, do all things necessary to be done by it in order to
operate said Utilities in a satisfactory and efficient manner;
provided that no increase or decrease in rates over those now
existing and fixed by said Commission may be charged by it
unless the approval of said new increased or decreased rates
is first had and obtained by a majority of the members of the
City Council. In case of a tie vote on such a proposition, a
quorum of the City Council being present, the Mayor may, as
in all other instances, cast the deciding vote on such proposal
to fix rates.

SEC. 104. Said Commission shall from time to time turn
over to the Mayor and City Council such part of the moneys
it has received, or which are not needed in the operation of
said Utilities, and any moneys so turned over to the Mayor
and City Council shall be applied by it first to the paying off
