CHAPTER 329.
(Senate Bill 372)

AN ACT to authorize the Board of Public Works to execute
and deliver to Joseph R. Benjamin and Jane Frances
Mallen, a deed conveying to the said Benjamin and Mallan
a tract of land owned by the State and constituting a part
of the Elk Neck State Forest, in exchange for a tract to
be deeded to the State by the said Joseph R. Benjamin and
Jane Frances Mallen, said exchange to be made for the
purpose of providing a more suitable entrance to the Elk
Neck State Forest.

WHEREAS: There was deeded to the State of Maryland
on May 9, 1936, a tract of land containing a 300 foot
entrance on U. S. Route No. 40 and

WHEREAS: It was found that the said strip of land was
not suitable for an entrance road and

WHEREAS: Another strip of equal frontage on said U. S.
Route No. 40 is satisfactory for the entrance road and

WHEREAS: The owners of said land have agreed to
exchange the same for the frontage now owned by the

State

SECTION 1. Be it enacted by the General Assembly of
Maryland,
That the Board of Public Works be and they
are hereby authorized and empowered to execute and
deliver to Joseph R. Benjamin and Jane Frances Mallen
of Cecil County, Maryland, a deed conveying to the said
Benjamin and Mallen a tract of land now forming part of
the Elk Neck State Forest and being more particularly
described as follows: Beginning at a stone situated on
the south side of U. S. Route No. 40, which is the begin-
ning of the Cosden-Mallen tract, thence following the south
edge of the right-of-way of U. S. Route No. 40, S 86 degrees,
W 1092 feet to a stake for a place of beginning for the
parcel of land to be conveyed. From this place of begin-
ning still following the south edge of the right-of-way S 86
degrees W 300 feet to a stake thence leaving the right-of-
way S 4 degrees E 300 feet to a stake, thence N 86 decrees
E 300 feet to a stake, thence N 4 degrees W 300 feet to
point of beginning of said parcel containing 2. 066 acres
more or less. Being a portion of the same tract of land
which was conveyed to the State of Maryland by Jane
