who fails or refuses to report or who reports falsely with
intent to deceive in answer to any requirements of this
Act or who shall interfere with the State Board of Health,
or its agents, in the proper enforcement of this Act, shall
be deemed guilty of a misdemeanor and, upon conviction,
thereof, shall be fined not less than twenty-five dollars
($25. 00) nor more than fifty dollars ($50. 00) for the first
offense, and for any subsequent offense shall be fined not
less than fifty dollars ($50. 00) nor more than one hundred
dollars ($100. 00). Provided, however, that nothing con-
tained in this Act shall apply to any common carrier or
any carrier for hire only.
SEC. 2. And be it further enacted. That if any of the
provisions of this Act or any sections or parts thereof shall
be held invalid for any reason, such holdings shall not be
construed as affecting the validity of any remaining sec-
tion or portion of a section of this Act.
SEC. 3 And be it further enacted, That all Acts or
parts of Acts, inconsistent with this Act, be and the same
are hereby repealed, to the extent of such inconsistency.
SEC. 4. And be it further enacted, That this Act shall
take effect June 1, 1935.

CHAPTER 313.
AN ACT to repeal Section 299—316N, inclusive, of Article
1 of the Code of Public Local Laws of Maryland (1930
Edition), title "Allegany County, " sub-title "Alcoholic
Beverages, " as said sections were enacted by Chapter 5
of the Acts of the Extraordinary Session of 1933, and to
enact in lieu thereof 33 new sections, to be known as Sec-
tions 299—316N, inclusive, of said Article, to license,
regulate and control the manufacture and sale of alco-
holic beverages within Allegany County and the importa-
tion of same into said County, and providing penalties for
the violation thereof.
