SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sections 101A and 101B of Article 39 of
the Annotated Code of Maryland (1929 Supplement), title
"Fish and Fisheries, " sub-title "Clams, " be and the same
are hereby repealed and re-enacted with amendments to
read as follows:
Section 101A. Any resident or land owner of Maryland
desiring to take or catch clams from the waters of Worces-
ter County for sale shall first obtain a license from the
clerk of the court of said county and shall pay the sum of
$5. 00, and in addition thereto 25 cents to the clerk of the
court for issuing same.
In addition to the license fee of $5. 00 above mentioned,
he shall further pay as part of said license the sum of 5
cents per thousand or fractional part thereof on all clams
caught by him and sold. This additional sum shall be paid
to the dealer to whom the clams are sold; or if he shall sell
direct to any person other than a licensed clam dealer the
sum of 5 cents per thousand or fractional part thereof shall
be paid to an inspector.
Said license shall be good for the year of issuance only.
All persons taking and catching clams under the provi-
sions of this section shall exhibit their license whenever re-
quired to do so by any officer of the Conservation Depart-
ment or other officer of the State.
Boys of twelve years of age and under shall not be re-
quired to secure a license.
Non-residents of the State desiring to take or catch
clams in the waters of Worcester County shall first obtain
a license from the clerk of the court of said county and
shall pay therefor the sum of $2. 00, and in addition thereto
25 cents to the clerk of the court for issuing the same, but
non-residents shall not be permitted to take clams for sale
under any conditions. The taking of more than one hun-
dred (100) clams per day by any person shall be prima
facie evidence of taking of same for sale.
Section 101B. Any person engaged in the business of
shipping or marketing clams taken from the waters of
Worcester County shall first obtain a license from the clerk
of the court of Worcester County and shall pay the sum of
$25. 00, and in addition thereto 50 cents to the clerk of the
court for issuing same.
Provided, that nothing herein contained shall be con-
strued to prohibit the catcher of clams to market his own
catch.
