on or the retirement of any bonds which may be issued for
the construction of sewers in said town. The said Mayor
and Council shall also have the power to provide, by ordi-
nance, for imposing a sewer rental or charge for the use of
said sewers or for the privilege of connecting with same,
the said rentals or charges to be used for the payment of
the interest on said sewer bonds and for the retirement of
the same and for the maintenance and improvement of said
sewer system and shall not be diverted for any other pur-
pose or discontinued until all of said sewer bonds shall have
matured and been paid. In the event that the said excess
surplus receipts from water and light, rents and the re-
ceipts from the charges or rentals for sewers shall not be
sufficient in amount to pay the interest on said sewer bonds
or the principal thereof, as it shall become due, the said
Mayor and Council shall annually levy on the taxable prop-
erty of said town such sums of money, in addition to the
levy heretofore authorized, as shall, in their discretion, be
necessary for the prompt payment of the interest on said
sewer bonds and the principal thereof as it may become
due.

SEC. 2. And be it further enacted, That this Act shall
not become effective until submitted to the voters of the
town of Berlin at such time as the said Mayor and Coun-
cil shall determine and unless approved by a majority of the
votes cast on said question. The said Mayor and Council
are hereby authorized to provide for the holding of such
election after giving five days' notice of said election.

SEC. 3. And be it further enacted, That this Act is
hereby declared to be an emergency law and necessary for
the immediate preservation of the public health and safety,
and having been passed upon by a yea and nay vote, sup-
ported by three-fifths of all of the members elected to each
of the two Houses of the General Assembly, the same shall
take effect from the date of its passage.

AN ACT to repeal and re-enact with amendments Sections
101A and 101B of Article 39 of the Annotated Code of
Maryland (1929 Supplement), title "Fish and Fisher-
ies, " sub-title "Clams, '* as same was enacted by Chapter
431 of the Acts of 1931.
