wine, beer or other spirituous or fermented beverages, con-
taining less than 8% of alcohol by volume, shall pay to
the Clerk of the Circuit Court upon the issuing of such
license the sum of twenty-five ($25) dollars for one year
or such pro rata part of said sum for a shorter period.
All the funds received by the Clerk of the Circuit Court
under the provisions of this section, less the Clerk's fee and
any refunds, shall be paid over by him to the County Com-
missioners of St. Mary's County, and one-half of said funds
so received by the said County Commissioners shall be used
by them in reducing the tax rate required to be levied for
the public schools of said County by the general state law
and one-half thereof shall be used for general county pur-
poses. "

Any person violating any of the provisions of this section
shall be punished by a fine not exceeding five hundred
($500) dollars.

127. It shall be unlawful for any licensee under this
Act to sell to any minor or habitual drunkard. And it shall
also be unlawful for any licensee under this Act to sell
liquors on the Sabbath Day commonly called Sunday, or
any Election Day, nor shall any liquors be sold by any
licensee between the hours of 12 midnight and 6 o'clock
A. M. But this section shall not prevent the sale of any
wine, beer or other spirituous or fermented beverages con-
taining less than 8% alcohol by volume, on any day or at
any time. Any person violating any of the provisions of
this section shall be deemed guilty of misdemeanor and
upon trial and conviction shall be subjected to a fine of not
less than fifty dollars nor more than two hundred and fifty
dollars, or may be confined in the County Jail or the House
of Correction for not less than sixty days; and the Court
in its discretion may suppress the license of any licensee,
and no license shall be issued either to the person or to the
place wherein the law has been violated for a period of six
months, and upon the suppressing of said license, there
shall be no return of the license money to the licensee.

SEC. 2. And be it further enacted, That this Act is
hereby declared to be an emergency law and necessary
for the immediate preservation of the public health and
safety, and having been passed upon a yea and nay vote,
supported by three-fifths of all of the members elected to
each of the two Houses of the General Assembly, the same
shall take effect from the date of its passage.
