CHAPTER 35.

AN ACT to repeal and re-enact with amendments Sections
125 and 127 of Article 19 of the Code of Public Local
Laws of Maryland (1930 Edition), and to repeal and
re-enact with amendments Section 126 of said Article
19 as the same was amended by Chapter 388 of the Acts
of 1933, title "St. Mary's County, " sub-title "Liquors
and Intoxicating Drinks. "

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sections 125 and 127 of Article 19 of the
Code of Public Local Laws (1930 Edition) and Section 126
of said Article 19, as the same was amended by Chapter
388 of the Acts of 1933, title "St. Mary's County, " sub-
title "Liquors and Intoxicating Drinks, " be and they are
hereby repealed and re-enacted with amendments to read
as follows:

125. No person shall hereafter sell, offer or keep for
sale in St. Mary's County, Maryland, any spirituous or fer-
mented liquors of any kind whatsoever, without having
previously obtained a license therefor as hereinafter pro-
vided, but this Act shall not apply to a sale or sales made
by any person under provisions of law requiring him to
sell personal property or to a sale of cider or native wines
by the maker thereof. All licenses to sell spirituous liquors
shall expire on the first day of May next ensuing the date
of their issue, and shall be issued for twelve months or any
lesser number of months, but for no fractional part of a
month. No license under this Act shall be issued for a
longer period than one year, and all licenses shall expire on
the first day of May in each year and if issued for a shorter
period than one year the licensee shall pay pro rata for
the number of months preceding said first day of May
proportioned to the license fee hereinafter provided for a
whole year. Any licensee under this Act shall be permitted
to sell in any quantities.

126. The applicant for a license to sell spirituous or fer-
mented liquors of any kind whatsoever, containing more
than 8% of alcohol by volume, shall pay to the Clerk of
the Cir cut Court upon the issuing of such license the sum
of one hundred dollars ($100) for one year or such pro
rata part of said sum for a shorter period. And any
licensee who shall take out said license shall have the right
to sell beer and all other alcoholic drinks or beverages of
any alcoholic contents. The applicant for a license to sell
