And the Defend.ts by W.m Hemsley their Att.ry comes and defends
the force and Injury when &c.a and prayes heareing of the aforesd
Bond or Writing which is [illegible] them they allsoe crave oyer
of the Condicon of the sd Bond or Writing and it is likewise read unto
them in these Wordes viz The Condicon of this obligacon is such
that Whereas the above bound Sarah Daniel and John Toaes have
bargained and sould unto the above sd Hugh Marsh a certain mill
and Two Stockes of Plank lieing by Delawar Road and other
appurtnances in and about the sd Mill with Two hundred Acres
of Land on the West side of the Mill dam therunto adjoyneing
according to boundes lieing and being att the head of Chester River
in Kent County aforesd for the sume of Forty Thowsand poundes
of Tobaccoe sound M.rchantable Tobaccoe the sd Hugh Marsh
haveing liberty to make use of what Timber may be Necessary &
convenient for repairing the sd Mill with in One hundred Acres
of Land next adjoyneing to the East End of the dam and to dig
Earth for the dam where it may be convenient without damag
to the house theron and likewise a certain Plantacon with the houses
and appurtnances lieing and being by the Long Meadow branch
containing about Three or Four hundred Acres att Three Thowsand
poundes of Tobaccoe p hundred Acres the whole sume for
the sd Mill Land and Plantacon to be paid in Wheat att Fifty pounds
of Tobaccoe p Bushel Indian Corne att Twenty poundes of Tobaccoe
p Bushel or in Tobaccoe in manner and forme following that is
to say One hundred Bushels of Wheat to be paid att or before y.e
10.th day of October next Ensueing the date hereof and the remaind.r
att Five Equal paym.ts on every 10.th day of October as they next
Follow If therfore the above bound Sarah Daniel and John Toaes
for better assurance of the bargained p.rmises according to Articles
and condicons as aforesd shall upon request of the aforesd Hugh
Marsh or his Heires give and grant unto him the sd Hugh Marsh
his Heires or Assignes a firme conveyance according to Law in full
confirmation of the promises aforesd to posterity att or before y.e
last day of September next Ensueing the date hereof that
then this obligacon to be voyd and of no effect
