On which sd day the sd Defend.ts by W.m Hemsley appeares
and prayes therof to Imparle until the next Court which
was granted the same day is given to the plt likewise

And now here att this day viz the 24.th day of Novemb.r
Anno Dom 1697 came as well the sd Plt by Richard Macklin
his Attorney as allsoe the sd Defend.ts by their sd Att.ry and
the sd cause standing for Tryal declr viz

John Toaes otherwise called Sarah
Toaes Daniel and John Toaes of sd County was summoned to
to Answer unto Hugh M.rsh late of Talbot County of a plea
that they render unto him the sume of One Hundred Thousand
poundes of sound M.rch.table Tobaccoe in cask which to him they
owe and from him they unjustly deteine

And Whereupon the sd Hugh by Richard Macklin his Attorney
complains and saith that wheras the sd Defend.t by their certain
writing obligatory sealed with the seale of the sd Defend.ts as their
act and deed delivered and hereinto Court brought whose date is
the same day and Yeare to Witt on the 4.th day of May Anno Dom
1695 in sd County within the Jurisdicon of this Court did acknowlidge
themselves to be holden and firmely bound unto the sd Hugh M.rsh
then of Talbot County in the sume of one hundred Thowsand
poundes of Tobaccoe quallified as aforesd to be paid unto the sd
Hugh Marsh or his certain Attorney Ex.rs Adm.rs of Assigns to which
paym.t the sd Defend.ts did bind themselves their Heires Exe.rs and Adm.rs
to &c.a Yett notwithstanding the sd Defend.ts the sd sume of 100000.ll of
Tobaccoe according to the Ten.r of the same obligacon unto the sd
Hugh Marsh they have not paid alltho often demanded but the same
to pay they have denied and still doe deny and refuse to the damage of
the sd Hugh M.rsh Two Hundred Thowsand poundes of Tobaccoe and therupon
he brings this suit    Macklin p q.r pledg &c.a Jn.o Doe Rich Roe
