Plea the sd Defend.ts by W.m Hemsley
their Attorney comes and defends the
Force and injury when &c.a and saith he the sd plt his Accon
aforesd ag.t them he Ought not to have and maintaine because
they say they have performed the condicon to the said obligacon
annexed and of this they put themselves upon the Country And
the sd Defend.ts by protestacon farther for a plea saith that they illway
higher have ever been ready and as Yett are ready to seale
deliver and Acknowlidge all such deed or deeds as in the Condicon
of the same Bond is Exprest for conveying the sd premises all
which they are ready to Aver and prove and prayes Judgm.t if
Accon

And plt in like manner Macklin

Command is therfore given to the sheerif of Kent County
to Cause Twelve good and Lawfull men of his Bailiwick
to come before this Court to Try the Issue Joyned as above
which said Jury are viz

above and haveing heard the pleadings on both sides ^the^ Court
giveth them their Chairg who withdraw somtime to consider
on the p.rmises and doe againe returne who being called over
as allsoe the plt and defend.t and being asked who they find for
say they find for the Plt and soe they say all

But the sd Defend.ts by their sd Attorney moves in Arrest of Judgm.t
but the reasons by them offered are not sufficient to Bar the said
Judgm.t
