Miller     And the said Michael as well by himselfe as by his attorny
  &         cometh and defends the Force and Injury when &c
Harris     and saith that the said William his action against him
plea        the said Michael ought not to have for that the said William
              be or required the said Michael to accompt with him the said
              William nor a coppy of the sd accompt did ever deliver unto
               him the said Michael as the Law in such cases hath made &
               provided and this he is ready to aver And demands Judgm.t
               wether the said William his Actions ought to have &c.a

Miller   And the said William Harris for Replication saith that
            the said plea of the aforesaid Michael Miller is not sufficient
            to barr him the said William of his Action aforesaid for that
            to the said William did often Require him the said Michael
            to acc.tt and that a Coppy of the said accompt to him the said
            Michael by him the said William did deliver before the
            bringing of the Originall Writt and that he is ready to averr
            and proves Judgment of this Court for his debts and cost &c.a
                                                    Harris pet.r

            And the said Michael saith that a Coppy of the accompt
            aforesaid he the said William did not deliver as abovesaid
                                                                            MMiller

            John Naid swore on M.r William Harris his behalfe to
            Testifie the truth of ^his^ Knowledge Betwixt y.e said Harris &           
            Miller

            The Court haveing heard his Evidence and the pleadings on
            both sides doe overrule y.e said Millers his plea but
            notwithstanding upon the said Millers request by the Consent
            of the said Harris he is permitted to demur to the Declaracon

            And the said Michael demureth to the said Decl and saith that
            one article to witt John Ellis his Judgm.t 900.ll of Tob being a Judgm.t
            ought not to be brought by Action of accompt it being a Judgm.t
            allready & the Article a Bill of 1976.ll Tob being a Bill an action
            of Debt lay & not accompt & of this he prayed Judgm.t
