358 This Indenture made this tenth day of August in the third year of the Reigne of our sovereigne Lord & Lady William & Mary by the Grace of God of England &c.a & in y.e year of our Lord Christ one thousand six hundred ninety & one Betweene Simon Wilmore & Rebecca his wife of y.e one part & Philip Davis of y.e s.d County Blacksmith of y.e other part Wittnesseth that the s.d Simon Wilmore for & in Consideration of y.e sum of three thousand eight hundred pounds of tobacco to him in hand paid at or before the ensealing & delivery of these presents the receipts whereof & every part & parcell thereof the s.d Simon Wilmore doth hereby acknowledg & for divers other considerations the s.d Simon thereunto moveing have given granted barganed Aliened sold enfeoffed & confirmed & by these presents doth fully clearly & absolutely give Grant bargaine alien sell enfeoffe & confirme unto y.e s.d Philip Davis a parcell of land being part of a tract called Stepney and begining at a bounded tree standing at the Landing formerly called Thomas Seawards Landing & running from thence north north west untill it intersect y.e south west line of y.e s.d Land called Stepney and with the s.d line north East untill it shall intersect a line drawn north west from the uper bounded tree of the s.d land being neare a spring & Marsh and containing by Esteemation about acres be it more or less oltogather with all its Rights members Jurisdictions & apurtenances with all houses Edifices buildings Land pastures woods trees wages easements profits & comoditys whatsoever to the s.d parcell of Land belonging or any wayes apertaining And also all y.e Estate Rights title & intrest use possession property claime & Demand of them or either of them y.e s.d Simon Wilmore and Rebecca his wife of in & to y.e same & all Deeds or writeings touching or concerning y.e same promises or any part or parcel thereof To have and to hold the s.d parcell of land & all and singular the promises hereby granted barganed & sold with every of their Rights members & apurtenances whatsoever unto y.e s.d Philip Davis his heirs & assignes to y.e onely proper use & behoofe of him the s.d Philip Davis his heirs & assignes for ever & the s.d Simon Wilmore & Rebecca his wife for themselves & their heirs the s.d parcell of Land and all & singular other the promises before granted barganed & sold with every of their Rights members or apurtenances whatsoever to the s.d Philip Davis his heirs & assignes for ever against them the s.d Simon Wilmore & Rebecca his wife their heirs Exct.rs Admt.rs & all & every other person or persons whatsoever claiming from by or under them or any of them shall & will warrant & Defend by these p.rsents And the s.d Simon Wilmore & Rebecca his wife for themselves their heirs Exct.rs Admt.rs doth covenant grant & agree to & with y.e s.d Philip Davis his heirs and every of them by these p.rsents in maner & form following that is to say that he y.e s.d Simon Wilmore & Rebecca his wife at the time of the ensealing & Delivery of these p.rsents hath full power good Right & Lawfull authority to grant bargaine sell & convey all & every y.e before hereby granted or mentioned to be granted promises with their & every of their apurtenances unto y.e s.d Philip Davis his heirs & assignes in maner & forme as afores.d And that the s.d Philip Davis his heirs & assigns and every of them shall & may by vertue of these presents from time to |
