290 singuler the appurtinances to the said Land belonging appertaining unto the said Daniell Toaes his heires and to the onely proper use and behoofe of the said Daniell Toaes his heires and assigns for ever And the said Judith Hemsley doth hereby grant for that shee and her heirs the said bargained tract of Land with the appurtenances unto the said Daniell Toaes heirs and assigns against all persons shall and will war.nt and for ever by these presents defend And ^she^ the said Judith Hemsley doth for selfe her heirs Execu.trs Adm.rs and Assigns Covenant promise and grant to and with the said Daniel Toaes his heirs & Assigns by these presents in manner and form following That is to say That is to say that the said Daniel Toaes his heirs and Assigns shall and may henceforth for ever pecably and quietly have hold occupy possess and enjoy the said bargained premisess wth their appurtenances wthout the Lawfull let trouble denyall eviccon Executcon or molestation of the said Judith Hemsley her heirs of Assignes and all other persons clameing any title to the same And that freed from all incumbrances what soever And that she the said Judith Hemsley shall and at any time here after at the reasonable request costs and Charges in the Law of the said Daniel Toaes make doe acknowledge levy suffer execute and finish all and every such further and other reasonable Act or Acts thing or things Conveyance or Assurance in the Law for the further assureinge and suremakeing of the said bargained premisses wth the Appurtenances unto the said Daniel Toaes his heirs and Assignes absolutely for ever In Witness whereof the parties above named to be present Indenture interchangeably their hands and seals have put the day and year first above written Signed sealed and delivered her in the presents of JudithI II Hemsly R Gouldsbrough marke Daniel Carnel Mich.ll Turbutt |
