CHAP. 193.

rect to which of said children, and in what proportion the-
rent shall be reserved and paid; allowing to said trustee
such commission as is allowed to trustees under the rules-
of the Chancery court.

Sec. 3. And be it enacted, That if the said trustee shall
neglect or refuse :to accept and excute the trusts hereby re-
posed in him, or if he shall die before he shall have com-
pleted the same, the Chancellor, on application to him by
or on behalf of any one interested in the execution of said
trusts, is hereby authorized to appoint another trustee, who
shall have all the power and authority, and be entitled to
the commissions hereby given to the said trustee, provided
the trustee so appointed shall comply with the terms and
directions of this act, so far as relates to said trustee's duty.

Sec. 4. And be it enacted, That nothing herein contain-
ed shall be taken or construed to defeat or affect the rights
of any creditor or creditors whatever; but all such persons
shall be at liberty to proceed for the recovery of their claims
as they might have done before the passage of this act.


CHAPTER 193.

Passed Mar. 12, 1833

An act to authorise and empower Horatio McPherson, of
Frederick county, the acting Executor of the last Will
and Testament of John McPherson, deceased, to execute
Deeds, and thereby to convey the legal title to certain Real
Estate.

Preamble

WHEREAS, it is represented to this General Assembly
by the petition of Horatio McPherson, the acting executor
of the last will and testament of John McPherson, late of
Frederick county deceased, that doubts are entertained
whether he, as sole acting executor, has the power to con-
vey by deed, the legal title to purchasers of such real estate
as it may become necessary for him in the discharge of his
said trust, to sell; and whereas, it is right and proper that
be should possess such power, as the same is essential to a
proper-and advantageous execution of his office, as exe-
cutor as aforesaid, and all doubts in reference to said pow-
er, ought to be removed — Therefore,

Be it enacted by the General Assembly of Maryland,
That Horatio McPherson, as the acting executor of the last
will and testament of John McPherson, late of Frederick
county, deceased, be; and he is hereby fully authorised and
