1832.

sale, to be executed, acknowledged and delivered by him
according to law, the legal title, in fee simple, of all such
real estate of the said testator as the executors named in
said will were authorised to sell and convey, to the purcha-
ser or purchasers thereof; and the said deed or deeds when


executed, acknowledged and delivered as aforesaid, by the
said Horatio McPherson, shall have the same force and
effect in law, as if he had been appointed the sole executor
of said last will and testament, and authorised as such by
said last will and testament, to sell and convey said real
estate to the purchaser or purchasers thereof.

CHAPTER 194.


An, act for the benefit of James Howard McHenry and
others.

Passed Mar. 11, 1833

Section 1. Be it enacted by the General .Assembly of Ma-
ryland, That Cornelia Annabella Howard, guardian of
John Eager Howard, an infant, and Charles Howard, guar-
dian of James Howard McHenry, an infant, be, and they
are hereby severally authorised, on behalf of their respec-
tive wards, to sign applications to the city commissioners
of the city of Baltimore, for the paving of any street, lane or
alley in the said city, whereon any of the real estate of their
said wards, derived from the late Colonel John E. How-
ard may be situated, and any such application for paving
so signed by either of the guardians aforesaid, shall have
the same force and operation in law, as regards the pro-
perty of his or her ward respectively, as though it had been
signed by a proprietor of full age, and the said guardians
shall, respectively be allowed, in their accounts with the
estates of their said wards, for all sums with which those
estates may be lawfully charged by the Mayor and City
Council of Baltimore, on account of paving done in virtue
of applications by the guardians as aforesaid, and which
shall be paid by the said guardians.

writing by any of the devisees of the late John Eager How-
ard or by the guardians in the aforegoing section of this
act named, for the digging down or filling up to its proper
grade, of any part of any public street, lane or alley in the
