tendance, and if any person residing without said limits,
shall be summoned and attend as aforesaid, such person shall
be entitled to receive, from the party summoning him or
her, the sum of one dollar for each and every day's atten-
dance, and such mileage as is now allowed by law.

Sec. 13. And belt enacted, That this act shall be and
continue in force until the first day of December 1834,
and until the end of the next session "of the general assem-
bly that shall happen thereafter.

An Act to prevent obstructions in Smith's and other Pri-
vate Docks in the City of Baltimore.
|

WHEREAS it is represented to the general assembly of
Maryland, that great inconveniencies are experienced for
the want of suitable regulations to prevent obstructions in
Smith's Dock, and in other private docks, in the city of
Baltimore; therefore,

Sec. 1. Re it enacted by the General Assembly of Ma-
ryland, That if any vessel shall be lying in Smith's Dock,
or in any other private dock in the city of Baltimore, or
the entrance thereof, so as to obstruct any vessel which shall
be coming into the same, or moving from one place to ano-
ther therein, or going out thereof, the vessel so obstructing,
unless when loading or unloading, shall be removed to such
place as shall be necessary to give room to the passing ves-
sel, under penalty, at the rate of five dollars an hour for the
delay which shall be occasioned to the passing vessel, to be
paid by the master or owner of the obstructing vessel, to
the master or owner of the passing vessel, unless in cases
where some unavoidable casualty or accident may make it
impracticable to remove the said obstructing vessel; and if
a vessel, when moving to make room for another, be ob-
structed by any vessel, the master or owner of such db-
structing vessel, unless when loading or unloading, shall for-
feit at the rate of five dollars an hour, during the continu-
ance, to be recovered by the master or owner of the pass-
ing vessel aforesaid; and said money shall be recovered in
the same manner that small debts' are recoverable before
any magistrate in the city of Baltimore; and every thing
contained in this clause applicable to vessels, or the own-
ers or masters thereof, shall be construed to apply to boats,
scows, rafts, arks, and the owners or masters thereof.

Sec. 2. And be it enacted, That all the wharfage dues ac-
cruing to the state, or to the city of Baltimore, or to the
owners of private wharves, may be recovered, respectively,
in the name of the state of Maryland, and for the use of
