CHAP. 161.

until six months after the lendition of such judgment, un-
less the goods and chattels shall be perishable, in which
case execution may issue by special order of the court after

judgments, &c

Sec. 11. And be it enacted, That if any defendant or
defendants, against whom any judgment shall hereafter be
rendered in the said court, shall, within sixty days after the
rendition of such judgment, appear before the clerk of the
said court, in his office, and together with two other per-
sons such as the said clerk shall approve of, confess judg-
ment to the same plaintiff or plaintiffs, or the survivor or
survivors of two or more plaintiffs, if one or more shall
have died after the rendition of such judgment, for the
same amount of debt, damages and costs, or damages and
costs, on the same conditions of release, as the case may
be, to be paid in two equal payments; that is to say, one
moiety of the whole original debt, with interest thereon, in
six months, and the other moiety of such debt, with inte-
rest, and all costs, in twelve months after the date of such
confessed judgment, it shall be the duty of the said clerk
to enter of record, on a separate docket te be kept for that
purpose, and indexed in the name of each of tbe parties,

deem it necessary, on oath, or affirmation, which he is
hereby empowered to administer, as to the sufficiency of the
sureties, and he shall be entitled to receive, at the time of
taking and entering such confessed judgment, the same fees
as are allowed by law for similar services; and such con-
fessed judgment shall be as effectual as any judgment enter-
ed or rendered in open court, and shall operate as a super-
sedeas and stay of execution on the original judgment, and
the several portions of it, agreeably to the terms and con-
ditions mentioned in such confessed judgment, and execu-
tion may issue thereon for each respective portion or moie-

ty thereof, if not paid when the same shall become due;
Provided, that if any execution, issued on the original judg-
ment, shall be actually served before the entry of the judg-
ment so onerating as a supersedeas, the sheriff, or other of-
ficer, serving the same, shall be entitled to receive his legal
fees and commission for such service from the defendant or
defendants, and the said court may regulate the form in
which every confession of judgment as aforesaid shall be
entered or recorded, and the form of certificate to be given
by the clerk of such entry.

Sec. 12. And be it enacted, That if any person residing
within the limits of the city of Baltimore, shall hereafter
be summoned as a witness in any cause pending in Balti-
more county court, and shall attend said court, such person
shall be entitled to receive, from the party summoning him
or her, the sum of fifty cents for each and every day's at-
