SECTION 3. Be it enacted, That the Mayor and Council of
Hagerstown, acting by and through the agency of said Com-
mission may acquire by gift, grant, purchase, lease (whatever
the duration of the lease) or any other like method of ac-
quisition, or by condemnation, any land or property, includ-
ing any drain, sewer, water course or stream of water, situ-
ated wholly or partly within the City of Hagerstown, or
within Washington County, or any interest, franchise, ease-
ment, right or privilege therein which may be required for the
purpose of constructing and establishing said sewerage system
when established, and when so often as resort shall be had to
condemnation proceedings, the procedure shall be as provided
by Chapter 463 of the Acts of the General Assembly of Mary-
land passed at its January Session, 1914, which said Act is
known as Article 33-A of the Public General Laws of Mary-
land, regulating the procedure for the acquisition of property
for public use by condemnation, so far as the acquisition by
condemnation of any such land or property, sewer, drain,
water course, stream of water, situated wholly or partly with-
in the City of Hagerstown or Washington County, or any
interest, franchise, easement, right or privilege therein, is
concerned (may in any case or cases, at the option of said
Commission at any time hereafter be provided for by any
lawful ordinance or ordinances of the Mayor and Council of
Hagerstown adopted pursuant to the power conferred upon
it by this Act).

And as often as said Sewerage Commission shall resort to
the acquisition of any land or property including any drain,
sewer, water course or stream of water, situated wholly or
partly within the City of Hagerstown or Washington County,
or of any interest, franchise, easement, right or privilege
therein which may be required for the purpose of construct-
ing and establishing said Sewerage Commission to apply to
the Mayor and Council for any ordinances or resolutions to
do so. but the said Commission may begin and prosecute to .
final conclusion any such condemnation in the name of the
Mayor and Council of Hagerstown without any such ordi-
nance or resolution. And the said Sewerage Commission of
Hagerstown is hereby authorized and empowered to sell in
any manner and upon terms, to be agreed upon, any portion
of the lands and property acquired by the said Commission
in the name of the Mayor and Council of Hagerstown, pur-
