An act to authorise the confirmation of the return of the
Commissioners in a certain case of proceedings under
the act to direct Descents, in Frederick County Court.

Preamble

WHEREAS, it has been represented to this General
Assembly, that sometime heretofore, a commission was
issued out of Frederick county court, in a case of pro-
ceedings in said court, under the act to direct descents,
for the division or sale of the real estate of Sabritt
Sollers, late of said county deceased, and wbich is dis-
tinguished as case number 27, on the docket of said
court, in cases of proceedings under the act to direct
descents; and that the commissioners therein named,
being of the opinion that the same could be advanta-
geously divided amongst the six heirs of said deceased,
by giving to one heir, in severally, one-sixth part in
value thereof, and to two of the heirs, as tenants in
common, inter se, one-third part in value thereof, and
to the remaining three heirs, as tenants in common,
inter se, one-half part in value thereof; and it being
suggested that the said division is advantageous and
convenient to all the parties interested, and is highly
approved by them; but that in consequence of the di-
rections of law, prescribing the manner of division in-
to parts, the return of the commissioners, if made,
could not be ratified and confirmed by the said court;
and it being further represented that a term has now
elapsed since the issuing of said commission; — There-
fore,

SECTION 1. Be it enacted by the General Assembly of
Maryland, That it shall and may be lawful for the
judges of Frederick county court, at the next term of
said court, to ratify and confirm the return of the com-
missioners, in the case of proceedings in said court,
under the act to direct descents, for the division or sale

and which is distinguished as case number 27, on the
docket of cases of proceedings in said court, under the
said act; provided, tbat the said return he made by the
said commissioners, or a majority of them, and be filed
in the office of the clerk of said court, at least ten days
