SEC. 2. And be it further enacted, That no person, firm or
corporation shall engage in the business of shipping clams in
Somerset County without having first obtained from the Clerk
of the Circuit Court of said County a license for said business
for which a license fee of Five Dollars shall be charged, two-
thirds of which sum shall be paid by the said Clerk to the
School Commissioners of Somerset County for the use of the
Public Schools in the said County; and of this amount the por-
tion received from white licensees shall go to the support of
the white schools, and the portion received from colored
licensees shall go to the support of colored schools, and the re-
-maining one-third shall be paid over by the said Clerk to the
Comptroller of the State Treasury to be credited to the Oyster
Fund.
SEC. 3. And be it further enacted, That every applicant
for a license as aforesaid, shall be required to make oath or
affirmation before the said Clerk, or before a Justice of the
Peace of Somerset County, or a Notary Public, upon whose
certificate of the taking of such oath or affirmation the said
Clerk shall issue said license, that the facts set forth therein
are strictly true, and that h© has been a resident of said County
for twelve months next preceding his application for said
license.
SEC. 4. And be it further enacted, That every such license
shall entitle the holder thereof to take or catch clams in the
waters of Somerset County during the calendar year for which
same is issued, and shall be issued upon printed forms sup-
plied by the Comptroller of the Treasury, who shall take re-
ceipts for the same from the said Clerk as for other licenses
furnished and said Clerk shall upon the first Monday of De-
cember in each year return to said Comptroller all unused
Licenses and shall pay over to him one-third of the amount
received by said Clerk for such licenses as in this Act pro-
vided.
SEC. 5. All clams that are offered for sale in the State of
Maryland, or that are manifested for shipment with any of the
transportations of Maryland for Interstate shipment, shall be
counted by the shipper, or his legal agent; the count of each
sack, barrel, or container of whatever description shall be
plainly marked, either on some conspicuous place on the con-
tainer itself, or on the tag containing the name of the consignee
and the consignor, these words "This Package Contains......
