CHAPTER 178.

AN ACT to repeal Chapter 34, Acts 1904, defining certain
duties of the City Surveyor.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Chapter 34 of the Acts of 1904, be and the
same is hereby repealed.

SEC. 2. And be it further enacted, That this Act shall take
effect from June 1, 1916.

Approved April 4th, 1916.

CHAPTER 179.

AN ACT to prohibit the taking or catching of clams in the
waters of Somerset County, except by residents of said
County, who have obtained a license to do so, to provide
licenses for clam shippers, regulating the sale of clams, and
providing penalties.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That it shall be unlawful for any person not a resi-
dent of Somerset County, to take or catch clams within the
waters of said County, and no resident of Somerset County
shall take or catch clams, with patent tongs, for sale, in any of
waters thereof, unless he shall first have obtained from the Clerk
of the Circuit Court of said County, a license which shall state
the name, color, age and residence of the person to whom such
license is granted, and the number of said license. Every appli-
cant fox such license shall pay to the Clerk of said Court before
the issuing and delivery of the same, a license fee of One Dollar
and Fifty Cents ($1. 50), and said Clerk shall also be entitled
to receive from said applicant the sum of Twenty-five Cents
(25c) as a fee for issuing said license, and administering the
oath required herein. Two-thirds of the amount received for
such license shall be paid by the Clerk to the School Commis-
sioners of Somerset County for the use of the Public Schools
in said County, and of this amount the portion received from
white tongers shall go to the support of white schools, and the
portion received from colored tongers shall go to the support
of the colored schools, and the remaining one-third shall be
paid over by the Clerk of said Court to the Comptroller of the
State Treasury, to be credited to the Oyster Fund.
