SEC. 8. And be it enacted., That all checks or other orders
for the payment of money shall be signed by the clerk of said
town and countersigned by the Mayor thereof; that the said
clerk shall be the custodian of the monies of said town and
other funds, and shall keep a full and accurate set of books
and accounts of the town's monies and funds, and of its rec-
ords and papers; he shall also keep a journal of the proceedings
of the council, which shall be open at all times for the inspec-
tion of any citizen; the said clerk shall act as the treasurer
of said town, and shall pay out the funds of said corporation
only upon the orders of the council to be signed by the presi-
dent thereof. He shall before he enters upon his duties take
the oath prescribed for members of the council, and execute a
good and sufficient bond in such amount and upon such condi-
tion as may be prescribed by the Mayor and council, with sure-
ties to be approved by said Mayor and council.
SEC. 9. And be it enacted, That the bailiff before enter-
ing upon the performance of his duties shall take the same
oath of office as the members of the council, and shall execute
a bond in such condition and in such amount as may be pre-
scribed by the Mayor and council with sureties to be approved
by the Mayor and council for the faithful performance of his
duties. He shall perform the police duties of the town and is
clothed with the same power as a constable under the general
laws of the State of Maryland; he shall promptly arrest all
violators of the ordinances of the town and bring them before
the proper officers to be dealt with according to law, and shall
promptly collect and pay over to the clerk all taxes and other
claims of said town which may come into his hands.
SEC. 10. And be it enacted, That the assessor or assessors
shall be appointed from among the citizens of said town quali-
fied to vote in said corporation, and before he or they shall
proceed to act he or they shall take an oath before a Justice
of the Peace of Garrett County that he or they will assess the
value of the assessable property of every sort within said town
at its full cash value without favor, partiality or prejudice to
the best of his or their skill and judgment; he or they shall
enter and record in a book to be provided for that purpose an
accurate and fair account of all properties, stocks and private
securities of every sort within said town liable to assessment
and the valuation thereof together with a list of the owners
thereof which shall be returned by him or them to the said
council on or before the third Monday in June of each and
