SEC. 4. And be it enacted, The Mayor and Council
shall have power to pass all such ordinances for conducting
the elections herein provided for or which may be hereafter au-
thorized to be held and shall make returns thereof to the Clerk
of the Circuit Court for Garrett County. And the qualified
voters of any of said elections shall be bona fide male residents
living within the corporate limits of the town of Accident,
shall be twenty-one years of age or over, who have been resi-
dents of the State of Maryland for the period of one year, and
of said town for the period of six months continuously next be-
fore the date of any such election; and that no one shall be eli-
gible for the office of Mayor and councilmen of said town unless
he shall be a real estate holder or owner of real estate of said
town. And the Mayor shall have been a resident of said town
for two years previous to his election, and the councilmen shall
have been residents of said town one year prior to their elec-
tion.

SEC. 5. And be it enacted, That if any vacancy shall occur
by death, resignation, removal or failure to act of the Mayor
or one or more of the councilmen elected as aforesaid the re-
maining councilmen or a majority of them shall elect a proper
person to fill said vacancy.

SEC. 6. And be it enacted, That every Mayor and council-
man before he proceeds to act as such shall make oath before
some Justice of the Peace of Garrett County that lie will dili-
gently and faithfully, according to the best of his skill and
judgment, perform the duties of Mayor or councilman as the
case may be, without favor, partiality or prejudice, and a cer-
tificate of such qualification shall be returned by the said Jus-
tice of the Peace to the said council to be filed and recorded
among their proceedings.

SEC. 7. And be it enacted, That the said council shall meet
at such place as they may appoint within said town, on the first
Monday of every month ensuing their election and as much
oftener by adjournment as they may deem necessary; that the
said council shall elect a president of the council, appoint a
clerk, a bailiff who shall also be the tax collector of the town,
an attorney, and one or more assessors of taxes and fix their
salary for compensation. All the officers appointed by said
council shall hold their respective offices for one year from the
date of their appointment or until their successors are appoint-
ed and qualified.
