mine to use, and continue the allowance now made
for the repair of the same, until the turnpike road
hereby authorized has been constructed on the said
road, or such, parts thereof as the company may
adopt.

Sec. 13. And be it enacted, That all persons
whatsoever traveling on said road shall be charge-
able with toll as provided in the seventh section

of this act; provided, that no funeral procession or
persons passing to or from church, or from one
part of his or her farm to another part thereof,
shall be chargeable with toll.

Sec. 14. And be it enacted, That all acts or parts
of acts inconsistent with this act be, and the same
are hereby repealed.

Sec. 15. And be it enacted, That this act shall
take effect and be in force from the date of its pas-
sage.

AN ACT to authorize the opening of a road, in
Carroll and Howard counties.

SECTION 1 . Be it enacted by the General Assembly
of Maryland, That William Zepp, of Carroll
county, and David Burdett and Augustus Davis,
of Howard county, be and they are hereby ap-
pointed commissioners to survey, lay out and open
a road not exceeding thirty feet in width, starting
from Watersville, in Carroll county, and running
on the most practicable route between the lands of
Burdetts, Dumpsey and Buckingham, thence to
the Baltimore and Frederick turnpike, in Howard
county, thence on the most practicable route at or
near Piper's and Davis' gate, in Howard county,
and the said commissioners shall make a plat of
that part of said road through Carroll county,
and return the same to the Clerk of the Circuit
