LAWS OF MARYLAND.

Court of , Carroll county, to be recorded; they
shall in like manner make a plat of .that part of
the road through Howard county, and return the
same to the Clerk of the Circuit Court for that
county for record, and the said road, when so
opened, shall be deemed a public road forever
thereafter, and shall be kept in repair as other
public roads are directed to be kept in said coun-
ties.

Expenses —
how paid.

Sec. 2. And be it enacted, That the expenses of
locating and opening that part of said road in
Carroll county, shall be paid by Carroll county,
and the expenses of locating and opening that
part of said road in Howard county, shall be paid
by Howard county, and the commissioners of said
counties are hereby authorized and required, on
receiving from the commissioners hereby appoint-
ed, an account, on oath, of the expense, including
an allowance of two dollars per day to the com-
missioners for their service, to levy the same on
the assessable property of said counties wherein
such expense may accrue respectively, to be col-
lected as other county charges are now collected.

Damages to
be valued.

Sec. 3, And be it enacted, That the said com-
missioners hereby appointed shall value the dam-
ages that may be sustained by the persons through
whose land the said road may pass, taking in
view the advantages and disadvantages of said
road to each, and the damages so ascertained shall
be levied and assessed in each county as other
charges are, and shall be paid by the county
wherein such damages may be sustained.

Required to
take an oath.

Sec. 4. And be it enacted, That the said com-
missioners, before they proceed to act, shall take
an oath before some Justice of the Peace, that
they will, without favor, partiality or prejudice,
assess the damages sustained by persons whose
lands the said road shall pass through, and that
they will perform all duties of commissioners
faithfully and to the best of their judgment.

In force.

Sec. 5. And be it enacted, That this act shall
take effect from the date of its passage.
