AN ACT to repeal the fourth section of the Act
of Assembly of eighteen hundred and fifty-three,
entitled, an act to amend the charter of the Phil-
adelphia, Wilmington and Baltimore Railroad
Company, so as to authorize and empower the
said company to build a bridge over the Susque-
hanna river, at or about Havre De Grace.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the fourth section of the Act
of Assembly of eighteen hundred and fifty-three,
chapter one hundred and thirty-eight, making it
the duty of the said company to construct two
draws in the bridge to be built over the Susque-
hanna river, by the Philadelphia, Wilmington and

Repealed.

Baltimore Railroad Company, be and the same is
hereby repealed; provided that nothing herein
contained shall be construed to release the said
company from any thing contained in the third
section of the said act of eighteen hundred and
fifty-three, chapter one hundred and thirty-eight.

Proviso.
|
|
Sec. 2. And be it enacted, That the said com-
pany be and they hereby are required and obliged
to build said bridge at a sufficient height to allow
a space of at least twenty-six feet above mean, or
average tide in the clear, for the passage of vessels
and steamboats under said bridge.

Sec. 3. And be it enacted, That the opening or
passage way on each side of the pivot draw, in
the western channel of the river, provided for in
the third section of the act hereby amended, shall
be at least severity five feet in width. And the
said company shall pay to Captain Virden, for
damages done to his property by the building of
the bridge without the eastern draw, the sum of
five thousand dollars, as full satisfaction for the
same.

Sec. 4. And be it enacted, That this act shall
take effect from the date of its passage.
