Sec. 2. And be it further enacted, That this act
shall take effect from the date of its passage.

AN ACT amendatory of the act of eighteen hun-
dred and sixty-four, chapter two hundred and
eighty-nine, entitled, "An act to incorporate
the Franklin and Powhattan Passenger Rail-
way Company."

SECTION 1. Be it enacted by the General Assembly
of Maryland, That so much of the seventh section
of the act of the General Assembly of eighteen
hundred and sixty-four, chapter two hundred and
eighty-nine, as requires the said railway to be
constructed from the western limits of the city of
Baltimore, to Powhattan via Franklin, be and the
same is hereby repealed, and the said company is
hereby authorized to construct their said railway,
from the western limits of the city of Baltimore,

to Powhattan by any practicable route; provided,
they shall first agree with the Calverton Turnpike
and Railroad Turnpike Companies, as to the terms
on which it may use the bed of said road, in re-
ference to toll, location and grade, in and of said
road or said turnpike.

Proviso.
|
Sec. 2. And be it further enacted, That the time
required for the commencement and completion of
said road specified in the fourteenth section of said
act, be and the same is hereby extended as fol-
lows, namely: the said company shall commence
the construction of said road within three years
and complete the same within six years from the
passage of this act, or the same shall be null and
void.
