A. W. BRADFORD, ESQUIRE, GOVERNOR.

Columbia, as the President and Directors of the
said company shall determine, through Frederick
and Montgomery counties, running within a half
mile of the town of Rockville, it being the inten-
tion of this act to authorize the construction of a
railroad from the said point of beginning to the
line of the District of Columbia, in order to facili-
tate a more direct communication from the West
and North-west with the city of Washington.

Sec. 2. Be it further enacted, That the said rail-
road hereby authorized, shall not exceed sixty-six
feet in width, but shall have the additions neces-
sary for excavations and embankments, and shall
have as many sets of tracts as the President and
Directors of the said company may deem neces-
sary, and in the construction and repair, of said
railroad, and in contracting for the right of way
for the same, and entering or using and excavat-
ing any land wanted for the use of the same, and
in the condemnation of land or material, or other
property, or of right of way, and in charging tolls
or rates for the transportation of persons or pro-
perty, and every other particular in which the
same are applicable, the said Baltimore and Ohio
Rail Road Company may have and exercise in re-
gard to the railroad by this act authorized, all and
singular, the powers given to the said' Baltimore
and Ohio Rail Road Company, in order to the
construction or repair of its rail road from the city
of Baltimore to the Ohio river, by the original
charter or act incorporating the said company, or
by any supplement thereto, so far as the said sup-
plements may relate to the said road from the city
of Baltimore to the Ohio river, and then said Bal-
timore and Ohio Rail Road Company in the con-
struction, repair and use of the said railroad by
this act authorized, shall be subject to the restric-
tions and limitations affecting the railroad from
the city of Baltimore to the Ohio river, so far as
the same are applicable.

Sec. 3. Be it further enacted, That if the capi-
tal stock of the said Baltimore and Ohio Rail Road
Company shall be deemed insufficient for the pur-
poses of this act, it shall and may be lawful for
the President and Directors of said company, or a
majority of them, from time to time, to increase
the said capital stock, by the addition of as many
