358 LAWS OF MARYLAND.

requirement, immediately proceed to construct or cause to be
constructed said section of diverted road and the said under
grade crossing structure in accordance with said plans and
specifications; the cost of the same not exceeding twenty thou-
sand dollars ($20, 000) as aforesaid, shall be paid and borne
equally by the said railroad companies. The work of con-
structing said diverted road and under grade crossing structure
shall be under the direction of the said commission and shall be
completed within twelve (12) months after the acquisition of
the land hereinbefore mentioned, but the said commission may,
in its discretion, extend said time for completion for a period
not exceeding six months; the said section of diverted road,
after its completion, shall be maintained by the County Com-
missioners of Anne Arundel county at the expense of the said
county, but the work and cost of material of the maintenance
of the said under grade crossing structure shall be done by the
said railway companies at their cost and expense, which cost
and expense shall be paid and borne equally by said companies.
Upon the completion of said section of diverted road and said
under grade crossing structure the said commission shall close,
and thereafter the said County Commissioners shall keep closed
the present public road from the point at which the diverted
road will connect with the present public road on the west
side of the right of way of the Washington, Baltimore and
Annapolis Electric Railway Company to a point where said
diverted road will intersect or connect with the present public
road to the east of the right of way of the Maryland Electric
Railways Company, and between said points said present road
shall not be reopened or used except with the consent thereto in
writing of the said railway companies, their respective success-
ors or assigns, and no public road shall be opened or used
thereafter across the rights of way of said railway companies
within six hundred yards to the north or south of said under
grade crossing structure. If, in the judgment of a majority
of said commission, it is unwise or impracticable to establish
said under grade crossing or if the estimated cost of said
under grade, including the cost of the construction of the sec-
tion of diverted road, but exclusive of the cost and expense of
acquiring the land necessary for said diverted road shall
exceed the sum of twenty thousand dollars ($20, 000), then the
said commission hereby created, unless the railroad companies
or either of them, or the County Commissioners of Anne
Arundel county are willing to pay, either jointly or severally,
the cost of said work over and above said sum of twenty thou-
sand dollars ($20, 000), and shall undertake, in writing, with
said commission, to pay the same, shall require the said rail-
